Plain English summary: SitterDeck is a tool to help you store pet care information. You keep ownership of your data. Subscriptions renew automatically and can be cancelled any time. We are not liable for errors in the care information you store. Please do not use the app to store information that could harm animals or people.

1. Who we are

SitterDeck is a mobile application developed and operated by ThomTech Real Solutions S.L., a company registered in Spain (the "Company", "we", "us", or "our").

By downloading, installing, or using SitterDeck you agree to these Terms of Service. If you do not agree, do not use the app.

2. The service

SitterDeck is a pet care information management tool designed for solo pet sitters and walkers. It allows you to create and store pet profiles, care notes, photos, and related information ("Content"). Features include:

You must create an account to use SitterDeck. You are responsible for:

4. Subscriptions and payments

SitterDeck offers a free tier and paid subscription plans (Starter, Busy Sitter, and Pro). Paid plans are billed monthly or annually through the App Store (Apple) or Google Play, depending on the platform you use.

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You can cancel at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time, except where required by applicable law.

All payments are processed by Apple or Google via their respective in-app purchase systems. We do not store your payment card details. Prices include VAT where applicable.

Downgrading: If you downgrade to a plan with a lower active pet slot limit, active pets above the new limit will be automatically archived (not deleted). If you downgrade to the free plan, archived pets are preserved in storage but will not be accessible until you resubscribe to a paid plan.

5. Your content

You retain full ownership of all Content you enter into SitterDeck. By using the service, you grant us a limited, non-exclusive licence to store, process, and display your Content solely to provide the service to you.

You are responsible for the accuracy of the information you store. SitterDeck is a note-taking tool: it does not verify, validate, or provide professional advice on any care information you enter.

6. AI features (Buddy AI and trading cards)

Buddy AI (voice intake): When you use voice intake, your audio recording is transmitted to OpenAI's Whisper API for transcription and then to GPT-4o-mini for structured extraction. The recording itself is not stored by us. OpenAI processes data according to their API data usage policies. You should not include sensitive personal data (such as payment details or government identification numbers) in voice recordings.

Trading card caricatures: When you generate a pet caricature, the pet's photo and a brief description are sent to OpenAI's image generation API. The resulting image is stored in your account. OpenAI's content policies apply; we cannot guarantee that every image generation request will succeed.

AI-generated content may not always be accurate or appropriate. You must review all AI-extracted information before saving it to a pet profile.

SitterDeck, including its name, logo, design, and all software, is owned by ThomTech Real Solutions S.L. All rights reserved. Nothing in these Terms grants you any right to use our name, trademarks, or branding without our prior written consent.

You own your Content. We own the app.

9. Data and privacy

Our Privacy Policy explains how we collect, use, and protect your personal data. It forms part of these Terms. By using SitterDeck you agree to our Privacy Policy.

10. Disclaimers

SitterDeck is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free from data loss.

Important: SitterDeck is a note-keeping tool, not a professional pet care or veterinary service. We are not responsible for any harm to animals or people arising from reliance on information stored in the app. You are responsible for verifying all care information with pet owners directly.

11. Limitation of liability

To the fullest extent permitted by applicable law, ThomTech Real Solutions S.L. and its directors shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of SitterDeck, including but not limited to loss of data, loss of income, or harm arising from care decisions based on information stored in the app.

Our total aggregate liability to you for any claim arising out of or relating to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or €50, whichever is greater.

Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

12. Termination

You may delete your account at any time from within the app or by contacting us at founders@sitterdeck.com. Upon deletion, your data will be removed within 30 days.

We may suspend or terminate your account if you breach these Terms. Where we do so without cause, we will refund any prepaid subscription fees for the unused period.

13. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes via the app or by email. The date at the top of this page reflects the most recent revision. Continued use of SitterDeck after changes take effect constitutes your acceptance of the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of Spain. If you are a consumer in the European Union, you also benefit from mandatory protections provided by the laws of your country of residence.

If you have a dispute with us, please contact us first at founders@sitterdeck.com and we will try to resolve it informally. EU consumers may also use the European Commission's Online Dispute Resolution platform.
